Welcome to Yume. These Terms and Conditions (“Terms”) govern your access to and use of the Yume platform, including our website, mobile applications, and related services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms.
1. Eligibility
You must be at least 18 years old and capable of entering into legally binding contracts to use Yume. By using the Service, you represent that you meet these eligibility requirements.
2. Account Registration
To book or host travel experiences, you must create a Yume account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.
3. Bookings, Payments, and Cancellations
Yume facilitates bookings and payments between travelers and experience providers. When you book an experience, you agree to the applicable cancellation policy and any terms provided by the host. Payments are processed securely through third-party payment providers. Yume acts as a limited payment collection agent for the host where applicable, but is not a party to the underlying agreement between traveler and host.
4. User Content
You may post reviews, photos, itineraries, and other materials (“User Content”). By submitting User Content, you grant Yume a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content in connection with the Service. You retain ownership of your content but agree that Yume may use it to promote the platform and enhance user experience.
5. Prohibited Conduct
You agree not to misuse the Service or engage in any conduct that:
- Violates any law, regulation, or third-party rights.
- Involves fraud, misrepresentation, or abuse of the platform.
- Disrupts or damages the integrity of the Service.
- Attempts to gain unauthorized access to accounts or systems.
Yume reserves the right to suspend or terminate accounts involved in any such behavior.
6. Intellectual Property
All content, code, design, and trademarks on Yume are owned by or licensed to Yume and protected by intellectual property laws. You may not copy, distribute, or create derivative works without written consent.
7. Privacy
Your use of the Service is governed by our Privacy Policy, which explains how we collect, use, and protect your personal information in accordance with applicable data protection laws.
8. Limitation of Liability
To the fullest extent permitted by law, Yume and its affiliates shall not be liable for any indirect, incidental, consequential, or punitive damages arising from or related to your use of the Service. Our total liability shall not exceed the amount you paid to Yume in the 12 months preceding the claim.
9. Dispute Resolution
These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in San Francisco, California, under the rules of the American Arbitration Association.
10. GDPR and CCPA Compliance
Yume complies with the General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA). Users in applicable jurisdictions have the right to access, correct, delete, or restrict the processing of their personal data, as outlined in our Privacy Policy.
11. Modifications
Yume reserves the right to update or modify these Terms at any time. Updates will be posted on this page with a revised “Last Updated” date. Continued use of the Service constitutes acceptance of the revised Terms.
